Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you andLagodish Tech, based at Złota 75A, 00-819 Warszawa (Wola), Poland (“Lagodish Tech,” “we,” “us,” or “our”), the operator of VibeCody, the website at vibecody.app, and related services (together, the “Services”).

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services for a company or another entity, you represent that you are authorized to bind it. If you do not agree, do not use the Services.

You must be at least 18 years old, legally capable of entering a contract, and permitted to use the Services under applicable law. You may not use the Services if you are subject to sanctions or other restrictions that prohibit such use.

You must provide accurate information, keep credentials confidential, and remain responsible for activity under your account and workspace. You may not share access in a way that bypasses plan, security, or permission controls.

Notify [email protected]promptly if you suspect unauthorized access. We may suspend access to protect you, other users, connected platforms, or the Services.

VibeCody provides tools for content planning, AI-assisted generation, avatar and voice workflows, media editing and rendering, approval, scheduling, publication through official third-party APIs, and platform-specific analytics. Features may vary by account, project, region, provider access, and plan.

The Services assist your production workflow but do not replace editorial, legal, advertising, medical, financial, or professional review. You remain responsible for every item you approve or publish.

You may connect accounts from TikTok, Instagram, YouTube, and other supported services using their official authorization flows. You authorize us to perform only the actions you request and approve within the permissions you grant.

Your use remains subject to each platform’s terms, policies, community rules, advertising and disclosure requirements, API quotas, audits, and technical restrictions. Platforms independently control moderation, processing time, visibility, monetization, account enforcement, metric definitions, and whether content is accepted or remains available.

We do not promise simultaneous public appearance across platforms. A shared schedule starts independent jobs; successful targets are not republished solely because another target fails.

Publishing requires your explicit approval of a specific content revision, media file, metadata, account identity, schedule, and disclosure settings. Editing approved media or metadata creates a new revision that requires new approval. Scheduled publication may occur automatically after that approval.

You must accurately classify advertising, sponsorship, branded content, synthetic or AI-generated media, paid placement, and content directed to children. You must use each platform’s required disclosure tools and must not hide advertising or attempt to evade platform enforcement.

You retain ownership of content you submit and of your rights in generated outputs, subject to applicable law and third-party terms. You grant Lagodish Tech a worldwide, non-exclusive, royalty-free license to host, copy, process, adapt, render, transmit, and display that content only as needed to provide, secure, support, and improve the Services.

You represent that you have all rights, releases, consents, licenses, and lawful bases needed for submitted brands, music, footage, images, scripts, claims, trademarks, personal data, and any person’s likeness or voice. You may not clone or imitate a person’s identity without valid authorization.

AI and automated tools can produce inaccurate, incomplete, biased, offensive, or non-unique output. Similar output may be generated for others. You must review factual claims, rights, safety, suitability, disclosures, and platform compliance before approval or use.

We do not guarantee that generated material is protectable by intellectual- property law or free from third-party claims. Do not rely on generated content as medical, legal, financial, or other professional advice.

You may not use the Services to:

• Create or distribute unlawful, fraudulent, infringing, deceptive, hateful, harassing, exploitative, sexually abusive, or dangerous content.
• Impersonate a person, use their likeness or voice without permission, or make misleading endorsements and testimonials.
• Automate likes, comments, follows, or other inauthentic engagement; use cookies, proxies, device emulation, or unofficial endpoints to evade platform controls; or interfere with moderation and disclosure systems.
• Introduce malware, probe security, scrape non-public data, overload systems, reverse engineer protected components, or gain unauthorized access.
• Use the Services or outputs to violate privacy, publicity, consumer- protection, intellectual-property, election, advertising, sanctions, or other applicable laws and platform rules.

We may investigate suspected abuse and remove content or restrict access where reasonably necessary.

Some private accounts or future features may use paid credits, subscriptions, or usage-based fees. No public paid plan or hosted checkout is currently offered through the VibeCody website. Before any purchase, the applicable price, included usage, renewal terms, and limits will be shown. Usage-based credits may be consumed when paid generation or rendering work starts and are not cash or transferable property.

Except where law requires otherwise, completed usage and consumed credits are non-refundable. You are responsible for applicable taxes. Payment processors may apply additional terms.

The Services depend on AI, media, cloud, payment, authentication, and social- platform providers that we do not control. Their terms and availability apply to your use. We are not responsible for their outages, policy changes, moderation, account restrictions, lost authorization, API limits, or independent acts and omissions.

The Services, software, interfaces, workflows, documentation, designs, and Lagodish Tech and VibeCody names and marks are owned by Lagodish Tech or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended purpose.

Feedback may be used without restriction or compensation, but we will not identify you publicly as its source without permission.

We may modify, limit, suspend, or discontinue features, including when a third- party provider changes access. We aim for reliable service but do not guarantee uninterrupted availability or that scheduled actions will complete at an exact time.

You may stop using the Services at any time. We may suspend or terminate access for breach, risk, non-payment, legal requirements, provider enforcement, or to protect users and systems. Provisions that by nature should survive termination remain effective.

Lagodish Tech is not liable for delay or failure caused by events beyond our reasonable control, including natural disaster, war, civil unrest, government action, widespread internet or telecommunications failure, power outage, labor disruption, or third-party platform and infrastructure failure.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” LAGODISH TECH DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. YOUR MANDATORY CONSUMER RIGHTS ARE NOT AFFECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAGODISH TECH AND ITS AFFILIATES, PERSONNEL, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, CONTENT, OR PLATFORM ACCESS.

OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US $100. THIS DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING FOR FRAUD, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

To the extent permitted by law, you will indemnify and hold harmless Lagodish Tech and its affiliates, personnel, licensors, and suppliers from claims, losses, liabilities, damages, and reasonable costs arising from your content, connected- account actions, breach of these Terms, violation of law or platform rules, or infringement of another person’s rights.

These Terms are governed by the laws of the Republic of Poland, excluding conflict-of-law rules. Courts competent for the seat of Lagodish Tech in Warsaw have jurisdiction, except that consumers retain mandatory rights and venues available under the laws of their country of residence.

Before filing a claim, contact [email protected] and allow 30 days for a good-faith attempt at informal resolution.

We may update these Terms. Material changes will receive reasonable notice, and the date above will be revised. Continued use after updated Terms take effect constitutes acceptance; if you disagree, stop using the Services.

These Terms and the Privacy Policy are the entire agreement about the Services. If a provision is unenforceable, the remainder remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction. The English version controls over translations.
